Landlord and Tenant Act 1985 (s.11)
Your landlord must keep in repair the structure and exterior of your home — including drains, gutters, external pipes and downpipes — and all installations for the supply of water and for sanitation. This covers the roof, walls, windows and all internal plumbing.
Housing Health and Safety Rating System (HHSRS)
Under the Housing Act 2004, local councils assess homes for hazards using the HHSRS. Excess water and damp are recognised Category 1 hazards that can require enforcement action against your landlord.
Homes (Fitness for Human Habitation) Act 2018
Since March 2019, rented homes must be fit for human habitation throughout the tenancy. A property with persistent leaks or water damage is unlikely to meet this standard, giving tenants a direct right to take their landlord to court.
Liability Once Notified
Your landlord becomes liable for damage caused by a leak once they have been notified of the problem (or ought reasonably to have known about it) and have failed to carry out a repair within a reasonable time. This includes damage to your belongings.
Social Landlord Standards
Registered providers of social housing (housing associations and council landlords) face additional obligations under the Regulator of Social Housing's consumer standards, including a duty to keep homes in a good state of repair and to respond to repair requests promptly.
